This seminar provides basic background knowledge for prison law practitioners on the processes of deportation and removal of foreign national prisoners.  The speakers will focus in particular on the legal framework and likely operation in practice of the new Tariff Expired Removal Scheme (TERS). The TERS, brought into force on 1 May 2012 by the Legal Aid, Sentencing and Punishment of Offenders Act 2012, now permits the expulsion from the UK of foreign national prisoners serving indeterminate sentences without reference to the Parole Board.

    • Consideration of the powers in the Borders Act 2007 and Immigration Act 1971
    • Removability- how to test if the UKBA/MOJ  are right
